ARMA Indy Meeting – eDiscovery and ESI – May 22, 2014

Join us on Thursday, May 22ndfrom 11:30 to 1:30 for a lunch meeting of the ARMA Greater Indianapolis Chapter, hosted by Ice Miller LLP. The meeting will be focusing on eDiscovery and the preservation of electronically stored information.

Preservation of ESI is fundamental to the litigation process in the Indiana state and federal courts and the failure to preserve can give rise to sanctions for spoliation. We will explore the role of records management in preservation, when the duty to preserve arises, what the scope of that duty may be, and the possible consequences for 'not getting it right.


The Federal Rules of Civil Procedure were amended in 2006 to address eDiscovery. Proposed amendments to the rules are now under consideration to again address eDiscovery. We must consider why the amendments were proposed, what the proposed amendments are intended to accomplish, and how the amendment process is proceeding.

Ronald J. Hedges – Retired Magistrate Judge
Ron was a U.S. Magistrate Judge in the U.S. District Court for the District of New Jersey for the Court Mediation program, a member of the Lawyers Advisory Committee, and both a member of, and reporter for, the Civil Justice Reform Act Advisory Committee. He has also served as a special master arbitrator and mediator and consults on management and discovery of electronically stored information. He is a member of The Sedona Conference Advisory Board.

Kenneth J. Withers – Deputy Executive Director, The Sedona Conference

Ken is the Deputy Executive Director of The Sedona Conference, a non-profit law and policy think tank which has been on the forefront of issues involving complex litigation, intellectual property, and antitrust law. Since 1989, he has published papers on e-discovery, hosted a popular website on electronic discovery and electronic records management issues, and given presentations at more than 3000 conferences and workshops for legal, records management and industry audiences.

L. Alan Whaley – Partner, Ice Miller LLP

Skip Whaley's primary areas of practice are litigation and appellate practice. He concentrates particularly in the areas of health and hospital law, long term care, e-discovery and privacy issues, product liability, administrative and regulatory practice and professional liability defense. He is a Certified Information Privacy Professional.
